Golden Visa holders do not need to become Tax Residents in Spain

The Golden Visa is the only kind of authorization to live in Spain that allows the Golden Visa holder to avoid becoming a tax resident in Spain, since once granted it is not necessary to go there for certain periods of time, nor to live there. Therefore, holders of a Spanish Golden Visa can benefit from all the Golden Visa advantages (such as traveling freely in the Schengen area 90 out of 180 days) without the need to become a tax resident in the country.

The Spanish tax residence rule states that anyone staying more than 182 days per calendar year in Spain, or having the centre of his vital interest here, will be considered a tax resident in Spain, and will be taxed for his worldwide income in Spain. This rule applies regardless of having or not a residence permit in place.

But the Golden Visa holders are not requested to live in Spain, and therefore they can enjoy and renew the Golden Visa as many times as they want, as long as the investment in real estate is held.

Moreover, you can get the Golden Visa for all of your family members, and as the property can be used without restriction the Golden Visa holders can get high returns from their investment if they rent out the property when they are not here.
